On July 17, 2020, a class action lawsuit was brought on behalf of veterans who contracted COVID-19 between March 1, 2020, and June 23, 2020, while living at the Holyoke Soldiers’ Home. The lawsuit is being heard in the United States District Court of Massachusetts in Springfield and is called Sniadach et al. v. Walsh et al., 20-CV-30115-MGM.
The parties have agreed to a $56 million settlement. Money from the settlement will be distributed to (a) veterans who lived at the Holyoke Soldiers’ Home and contracted COVID-19 from March 1, 2020, to June 23, 2020, or (b) those who have been appointed as the personal representative of a person who fits this description, whether that person is still living or is now deceased.
The estates of qualifying veterans who died prior to June 23, 2020, will be eligible to receive a minimum payment of no less than $400,000, and qualifying veterans who survived past June 23, 2020, to receive a minimum payment of no less than $10,000.
The judge has appointed a Claims Administrator, Donald K. Stern of Affiliated Monitors, Inc. , who will allocate the settlement funds. This website provides information to help Claimants learn about and exercise their options.
To receive payments as part of this settlement, veterans or their representatives must submit a claim to the Claims Administrator as is described on this site, by submitting a Claim Form, Release, and Questionnaire to the Claims Administrator by August 16, 2022. If there is no interest in receiving any payment from this settlement, then nothing need be done. Alternatively, a Claimant may elect to object to the terms of the settlement, or opt out of the process altogether if the Claimant wants to proceed with their own lawsuit.
